ELDER LAW

Generally, Elder Law refers to issues related to, Medi-Cal planning and/or Elder Abuse.

Medi-Cal (known as Medi-Caid in other states) is a government aid program that provides benefits to applicants who qualify. A main benefit is full payment of skilled nursing home care. The rules for qualification, reporting and repayment are very complex and change. Specific rules apply to married couples with an objective of avoiding impoverishing the spouse that lives at home because of the costs of nursing home care for the other spouse. Unfortunately, it is common for people to receive incorrect advice on how to qualify for Medi-Cal. It is best to consult with an attorney regarding Medi-Cal as part of estate planning well in advance of needing to apply for Medi-Cal.

Elder Abuse is typically financial or physical harm to an elder. It is perpetrated by family members as well as strangers and it is a crime. Law enforcement agencies can take action against elder abuse. Additionally civil remedies are available. The best defense against elder abuse is a well thought out estate plan with persons in place to assist an elder when needed. If you suspect an elder is being coerced to do something they would not do, like giving away their money, buying unusual things, isolating themselves, allowing someone to live with them, or signing documents giving someone access to their private affairs you should contact an attorney right away to discuss your options for taking action to prevent further abuse and for seeking recovery for what was lost.
